Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Ether ("we," "us," or "our"), the operators of the Ether web application at etherapp.ai. Please read them carefully. They include important provisions affecting your legal rights, including a binding individual arbitration clause and class-action waiver in Section 13.

  1. Acceptance. By accessing or using Ether, you agree to be bound by these Terms and our Privacy Policy and Disclaimers. If you are using Ether on behalf of an organization, you represent that you have authority to bind that organization.
  2. Eligibility. You must be at least 13 years old to use Ether. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
  3. Your account. One account per person. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Do not share, transfer, or sell your account. Notify us immediately of any unauthorized use.
  4. Acceptable use. You agree not to, and not to help anyone else:
    • harass, threaten, defame, or harm other users;
    • post hateful, harassing, sexually explicit, or illegal content;
    • impersonate any person or entity, or misrepresent your affiliation;
    • circumvent rate limits, authentication, or security features;
    • scrape, crawl, or systematically extract content from Ether;
    • reverse-engineer, decompile, or probe Ether for vulnerabilities outside a responsible-disclosure context;
    • attempt to extract copyrighted material that Ether does not host;
    • use Ether outputs to train, fine-tune, or evaluate competing AI models or services;
    • use Ether in any way that violates applicable law.
  5. Your content. You retain all rights to the journals, posts, comments, reflections, and other material you create in Ether ("Your Content"). By submitting Your Content, you grant Ether a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit Your Content solely to operate and provide the service — including, where you choose to make content public (for example, a shared post), displaying it to other users. You can delete Your Content at any time, which terminates this license prospectively. You represent that Your Content is yours to share and does not infringe anyone's rights.
  6. Our content. Ether's original topical overviews, paraphrased talk summaries, user interface, code, and other proprietary material ("Ether Content") are owned by us or our licensors and protected by copyright and other laws. You may read Ether Content for your personal study, quote short passages with attribution, and link to individual pages. You may not scrape, redistribute, resell, or bulk-download Ether Content without our written permission.
  7. Third-party content. Scripture texts used in Ether are in the public domain. Linked General Conference talks, Church manuals, and related materials, along with all associated trademarks (including "The Church of Jesus Christ of Latter-day Saints"), are the property of Intellectual Reserve, Inc. and its licensors. Ether is not affiliated with, endorsed by, or sponsored by The Church of Jesus Christ of Latter-day Saints. Our use of Church names and links is solely for study, citation, and attribution. If you believe material on Ether infringes your copyright, send a DMCA notice to support@etherapp.ai with the subject line "DMCA" and include the statutorily required information (identification of the work, the infringing material's location on Ether, your contact information, a good-faith statement, and your signature). Repeat infringers' accounts will be terminated.
  8. AI outputs. Ether uses AI to generate answers. AI outputs can be inaccurate, incomplete, biased, or inappropriate — even when they sound confident. Ether is not ecclesiastical counsel, not medical, mental-health, legal, financial, or other professional advice, and not a substitute for your own study, prayer, or consultation with qualified advisers or priesthood leaders.   9. Disclaimer of warranties. Ether is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that Ether will be uninterrupted, error-free, secure, or that defects will be corrected.
  10. Limitation of liability. To the maximum extent permitted by law, Ether and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of Ether — even if advised of the possibility of such damages. Our aggregate liability to you for any claim arising out of or related to Ether is limited to the greater of (a) US $100 or (b) the amount you have paid us in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.
  11. Indemnification. You agree to defend, indemnify, and hold harmless Ether, its operators, affiliates, and their respective officers and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of Ether, (c) your breach of these Terms, or (d) your violation of any law or third-party right.
  12. Termination. We may suspend or terminate your access to Ether at any time, with or without notice, if we believe you have violated these Terms or pose a risk to Ether or other users. You may terminate your account at any time by emailing support@etherapp.ai. Sections 5, 6, 9, 10, 11, 13, 14, and this sentence survive termination.
  13. Governing law; disputes; individual arbitration; class-action waiver.
    • These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.
    • Informal resolution first. Before filing any formal claim, you agree to try to resolve the dispute informally by emailing support@etherapp.ai with a description of the issue. We'll try to resolve it within 30 days.
    • Binding individual arbitration. If the dispute is not resolved informally, you and Ether agree to resolve any claim through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Salt Lake County, Utah. Judgment on the award may be entered in any court of competent jurisdiction.
    • Class-action waiver. You and Ether each waive any right to participate in a class action, class arbitration, or representative action. Claims may be brought only in an individual capacity.
    • Small-claims carve-out. Either party may bring an individual action in small-claims court in the county of their residence for claims within that court's jurisdiction.
    • 30-day opt-out. You may opt out of the arbitration and class-action-waiver provisions by emailing support@etherapp.ai with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
  14. Changes. We may update these Terms from time to time. For material changes we'll notify you in the app and update the "Last updated" date. Continued use of Ether after an update means you accept the revised Terms.
  15. Miscellaneous. These Terms (together with our Privacy Policy and Disclaimers) are the entire agreement between you and Ether regarding the service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
